1. Acceptance of Terms

By accessing, using, or making purchases through the Shankt Golf mobile app, website, or any related services (collectively, “the Platform”), you agree to be bound by these Terms & Conditions (“Terms”), even if you fail to read all the terms here in. If you do not agree with any of the terms or conditions, do not use the Platform. By using the Platform, you are agreeing to all terms and conditions.

 

Shankt Golf, LLC (“Shankt,” “SafeShank,” “we,” “our,” or “us”) reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform or notification to you. Continued use constitutes acceptance of the modified Terms.

 

2. Eligibility

  • Users must be 18 years of age or older to register or purchase any product, including Golf Damage Waivers (GDW).

  • Users represent and warrant that the information provided during registration is accurate and current.

  • The Platform is intended for use in the United States. International users are responsible for complying with local laws.

 

3. Services Provided

Shankt Golf provides:

  1. Tee-time search and booking through integrated and non-integrated golf course listings.

  2. Membership options, including Free and Premium subscriptions.

  3. Golf Damage Waiver (“GDW”), managed through SafeShank, a contractual benefit that waives the golfer’s financial responsibility for accidental property damage during a round, subject to its own Terms & Conditions.

  4. Event waiver options for golf events and tournament hosts.

The Platform may also provide general golf content, promotions, or partnerships.

 

4. Memberships and Fees

  1. Free Membership: basic access to search and limited booking functionality.

  2. Premium Membership: $9.99/month (3-month minimum) or annual equivalent; includes GDW up to $1,000 per incident.

  3. Booking Fees: Non-members pay a flat $2 booking fee when reserving through integrated partners.

  4. GDW One-Time Purchases: $14.99 per round for up to $500 waived; $19.99 for up to $1,000 waived. Must be purchased before the scheduled tee time.

 

Payments are processed via Stripe or other secure third-party processors.


By providing payment information, you authorize Shankt to charge applicable fees and taxes.

All charges are non-refundable except as required by law.

 

5. Golf Damage Waiver (GDW)

The GDW is governed by its own Golf Damage Waiver Terms & Conditions.

Key provisions include:

  • The GDW is NOT INSURANCE and provides no indemnity or reimbursement.

  • It is a contractual waiver in which Shankt Golf voluntarily agrees to waive a user’s financial responsibility for reported accidental property damage caused by the (User) purchaser’s golf ball, subject to these limitations.

    • Property Damage Definitions and Limitations:​

      • GDW applies can be applied to home windows, home window screens, patio or pool screens, patio furniture, home exterior siding, vehicle damage isolated to the cosmetic damage due to the direct impact of the purchaser's golf ball.

      • The Golf Damage Waiver does not apply to bodily harm of either users or other persons or animals that are injured or hit by an errant golf ball, up to including death. 

  • Incident reports must be submitted within 24 hours via the app or website.

  • GDW must be purchased prior to tee-time and confirmed via timestamp.

  • Shankt reserves the right to coordinate repairs through approved vendors instead of direct reimbursement.

  • Financial limitations are strictly capped at the amounts up to either $500 or a maximum $1000 depending on the user's purchase.

  • If the damages are under the maximum amount purchased, Shankt Golf, LLC (SafeShank) is only obligated to pay those costs.

  • Acts of gross negligence, reckless play, or intentional misconduct immediately void this waiver.

    • Including: Deliberately hitting into residential areas, knowingly playing under the influence of alcohol or drugs, or continuing to play after being warned of unsafe conditions.

    • Shankt Golf, LLC reserves the sole right to determine whether an incident falls under these exclusions.

 

6. User Responsibilities

By using Shankt, you agree to:

  • Use the app and services only for lawful purposes.

  • Not impersonate another person or submit false information.

  • Not interfere with the app’s functionality, servers, or security.

  • Comply with all golf course rules and etiquette.

  • Acknowledge that golf inherently carries risk of property damage and personal injury.

 

7. Intellectual Property

All logos, trademarks, graphics, text, and software are property of Shankt Golf, LLC or its licensors.
You may not reproduce, modify, distribute, or exploit any content without prior written permission.
“Shankt,” “SafeShank,” and “Swing Fearless” are trademarks of Shankt Golf, LLC.

 

8. Third-Party Services

Shankt integrates with third-party systems including:

  • Lightspeed Golf API (tee-time data and course information)

  • Stripe (payment processing)

  • Firebase (authentication, analytics, and storage)

Each third-party provider has its own privacy and terms. Shankt is not responsible for their content, accuracy, or policies.

 

9. Data Collection and Privacy

Shankt collects and processes personal information as described in our Privacy Policy.
By using the Platform, you consent to our collection and use of data for providing services, improving performance, and processing transactions.

 

10. Disclaimers and Limitation of Liability

  • The Platform, content, and services are provided “as is” and “as available.”

  • Shankt makes no guarantees regarding accuracy, availability, or fitness for a particular purpose.

  • Shankt Golf, SafeShank, affiliates, and employees are not liable for any indirect, incidental, or consequential damages.

  • Total liability shall not exceed the greater of:

    • The fees you paid to Shankt in the past 12 months, or

    • $100 USD.

Golf inherently carries risks. By using the Platform, you accept all such risks.

 

11. Account Termination

Shankt may suspend or terminate any account for violation of these Terms or misuse of the Platform.
Users may delete their accounts by contacting support@shankt.com.

 

12. Dispute Resolution and Governing Law

These Terms are governed by the laws of the state in which the incident happened, without regard to conflict-of-law principles.

Certain states may not allow GDW to be applied. Please contact our support for specific governance.
All disputes shall be resolved exclusively in Lafourche Parish, Louisiana.
Users waive any right to class-action proceedings.
